General Terms and Public Offer Agreement

Welcome to Marina Mamonova Photography. By booking our services or using this website, you agree to the general terms described in this document. This agreement constitutes a public offer directed at any individual or entity interested in hiring our professional photography services.

1. Purpose of the Agreement

1.1. This agreement governs the provision of photographic services by Marina Mamonova Photography (hereafter referred to as the “Photographer”) and the usage rights of the delivered images by the Client.
1.2. The services offered include photography sessions, image editing, and, where applicable, the creation of customized visual concepts based on the Client’s request.

2. Acceptance of the Offer

2.1. The Client accepts the terms of this offer by placing an order, completing a form, or making a partial or full payment for the services.
2.2. The Client confirms that they have read, understood, and agreed to the terms of this agreement before submitting any request.

3. Services and Conditions

3.1. The Photographer commits to conducting professional photography sessions in accordance with the technical specifications agreed upon with the Client.
3.2. Additional services, such as concept creation or prop acquisition, will be quoted and invoiced separately.
3.3. Final images will be delivered in JPEG format, sRGB, at the resolution specified in the Client’s request.

4. Usage Rights for Images

4.1. The Photographer retains all copyrights over the created images.
4.2. The Client is granted an exclusive license to use the images for commercial purposes, including publication on marketplaces, social media, print materials, and websites.
4.3. The license is unlimited in time and territory but does not transfer copyrights or permit unauthorized modifications to the images.
4.4. The Photographer reserves the right to use the images in their portfolio, on social media, or for professional promotion.

5. Fees and Payments

5.1. Service prices are detailed on the booking page or will be directly agreed upon with the Client.
5.2. A deposit of 50% of the total price is required to confirm the photography session booking. This deposit is non-refundable in the event of cancellation by the Client.
5.3. The remaining balance must be paid within [insert time frame] days after the images are delivered.

6. Delivery and File Storage

6.1. Images will be delivered within a maximum of 14 business days after the photography session.
6.2. Images will be accessible via a cloud storage link for 3 months. After this period, file availability is not guaranteed.

7. Dispute Resolution

7.1. The parties agree to resolve any disputes amicably through negotiation.
7.2. If no agreement is reached, disputes will be settled in the competent courts of Spain, under the applicable legislation.

8. Modifications to the Offer

The Photographer reserves the right to modify the terms of this offer at any time. Changes will take effect upon their publication on this page and will not affect ongoing agreements.
