General Terms and Public Offer Agreement

By hiring Marina Mamonova Photography services, the Client agrees to the following terms.

1. Scope of services

1.1. This agreement governs photography, video production, and visual design services.

1.2. Services may include:

– Product photography

– Video production

– Graphic design (Amazon listings, infographics)

– Creative direction

1.3. Detailed scope is defined in the commercial proposal.

2. Acceptance

2.1. The Client accepts these terms upon payment, approval, or order confirmation.

2.2. Communication via email or messaging is legally valid.

3. Services

3.1. Services are delivered according to agreed specifications.

3.2. The Client selects final images from previews. Only selected images are edited and delivered.

3.3. Files are delivered in JPEG (sRGB), unless agreed otherwise.

3.4. Additional formats (TIFF, clean versions) may be provided upon request.

3.5. Design files may be delivered in editable Figma format.

4. Usage rights

4.1. The Photographer retains full copyright ownership.

4.2. The Client receives a non-exclusive, worldwide, unlimited commercial license.

4.3. This includes use for: 

– Amazon, websites, social media

– Advertising and marketing

– Digital and print materials

4.4. Technical adaptations (cropping, resizing) are allowed if the visual essence is preserved.

4.5. Copyright ownership is not transferred.

4.6. Usage rights become valid only after full payment. Unpaid usage is considered unauthorized.

4.7. The Photographer may use the work for portfolio and promotion.

5. Pricing and payment

5.1. Prices are defined in the proposal.

5.2. A deposit is required to confirm booking.

5.3. The deposit is non-refundable.

5.4. The remaining balance is paid after delivery or as agreed.

5.5. Prices are stated excluding VAT unless specified.

6. Delivery and storage

6.1. Delivery time is defined in the proposal.

6.2. The Client has 7 calendar days for review.

6.3. Files are stored for a limited period (e.g., 3 months).

7. Liability

7.1. The Client guarantees rights to all provided materials.

7.2. The Client is fully responsible for music or third-party content provided.

7.3. The Photographer is not liable for third-party claims.

8. Music

If the Client provides music, it must be delivered before editing begins.

9. SEO content

The Client may provide SEO keywords.

10. Disputes

Disputes will be resolved amicably or under Spanish jurisdiction.

11. Changes

The Photographer may update these terms.
